Have you too received an ‘invoice’ or ‘calculation’ from the Reproduction Rights Organization (Stichting Reprorecht)? Then don’t pay it unquestioningly! In many cases you simply do not need to. If you do, it can cost you a great deal unnecessarily for many years!
The Reproduction Rights Organization is a legal entity appointed by the Ministry of Justice to collect payments owed by individuals to copyright holders if works on which copyright rests are copied. Instead of a percentage of the total number of estimated copies multiplied by € 0.045 per copy as the basis for the reproduction rights fee (the old system), now a system of fixed amounts is being used. Based on negotiations with the Confederation of Netherlands Industry and Employers VNO-NCW and the Dutch Federation of Small and Medium-sized Enterprises, these parties have drawn up a rates table, on the basis of which the fees are calculated. Companies are classified in these tables based on the number of employees and the sector in which the company is active. The amounts to be paid vary from € 15.62 to € 4,350 per annum. Contrary to what the Reproduction Rights Organization would have you believe, you are not obliged to pay the amount stated in the ‘invoice’ unquestioningly. This is only an offer by the Reproduction Rights Organization to reach agreement with you on the amount of the fee you should pay!
Our objection to this new method is exactly the same as the objections we had to the previous method: companies that make fewer copies of copyright material than the number for which they are charged would, according to this scheme, have to pay more for copies never made. This is unfair and contrary to the purport of the law.
We have developed a legal method which we believe makes it impossible for the Reproduction Rights Organization to collect the fee it proposes. This method is based on the principle that you set up your business processes on a firm legal basis in such a way that you do not make copies of copyright-protected works, which means that you do not need to pay anything now or in the future.
This method has been developed in response to the many requests which we have received from our clients, this year as well, to reply to the Reproduction Rights Organization. We assist you as the entrepreneur in this case for a fixed fee of € 225. If we have already acted on your behalf in a reproduction rights case, a fee of € 65 excluding BTW (Dutch VAT) will apply (i.e. EUR 89.25 including 19% BTW).

You will receive from us straight away an email confirming receipt, the conditions for participation in our campaign and a unique reference.
If you are in agreement, you transfer the amount applicable to you, stating the reference that has been assigned to you. Once you have paid, the case is confirmed.
We will then send you an email confirming the case and provide you with specific advice concerning the steps that need to be taken straight away to support our rejection of the offer from the Reproduction Rights Organization that we will send.
We will reply on your behalf in writing to the ‘invoice’ or ‘calculation’ sent by the Reproduction Rights Organization, rejecting its offer and giving reasons.
We advise you on how you can set up your business processes on a legal basis in such a way that will prevent you from having to pay unnecessarily the fee requested.
We will conduct trial proceedings if necessary, with your support, in order to expose the methods employed by the Reproduction Rights Organization;
Under the pressure of mass objections, including our campaign, the old scheme was abolished. Support us too in exposing this new scheme.
If other companies do not agree with the new ‘invoices’ or ‘calculations’, we can also lodge an objection on their behalf should they so wish. For existing reproduction rights clients, as already said we will charge a reduced fee of € 75 and for our new clients € 225. Naturally this includes any follow-up correspondence relating to the ‘invoices’.
